It appears that despite service, respondent No. 3 has not engaged an advocate nor any authorized representative of respondent No. 3 is present.

The writ petition arises out refusal of request by the petitioner to release the statutory amount under the provisions of The Employees' Provident Funds and Miscellaneous Provisions Act, 1952. However, according to the authority, the employer has not co-operated with the Enforcement Officer and failed to furnish any detail despite Enforcement Officer's visit. Despite service, none appears for the respondent No.3.

Therefore, Chairman of respondent No.3 shall remain personally present before this Court on 9 April 2026,

It is made clear that if he failed to remain present before this Court, this Court will consider issuance of non-bailable warrant against him.
