The learned counsel for the petitioners submits that the defence of the petitioners is inter-connected between the two suits filed by the respondents / plaintiffs. He relies upon the judgment of Chitivalasa Jute Mills Vs. Jaypee Rewa Cement, dated 04.02.2004, AIR 2004 SC 1687, more particularly, paragraph no.12 and submits that both the suits be tried before the one court so as to avoid conflict of findings.

Issue notice to the respondents, returnable on 15.10.2025. Notice to indicate that if time permits, the matter may be disposed of at admission stage. In the event, it is not possible to dispose of the matter for any reason, this court will consider prayer for interim relief.
