Writ Petition No. 10880 of 2025 :

Ms. Seema Sarnaik, learned Senior Counsel for the Petitioner in Writ Petition No. 10880 of 2025 states that she has instructions to withdraw the Writ Petition. However, learned Senior Counsel submits that as the daughter is having Diwali Vacation from 17th October 2025 to 2nd November 2025, the Petitioner be

permitted to take the daughter and son out of Pune from 17th October 2025 to 27th October 2025.

Learned Senior Counsel further states that the Petitioner has no objection if the father spends vacation with both the children as per his convenience from 28th October 2025 till 2nd November 2025 at Pune.

Ms. Gondhalekar, learned Counsel for the Respondent, on instructions, states that the Respondent is agreeable for the same. 4.

Accordingly, the Writ Petition No. 10880 of 2025 is allowed to be withdrawn, subject to above.

Liberty is granted to the Petitioner to apply for modification of the Order dated 15th February 2024 passed by learned Judge, Family Court No.2- Pune regarding access of Saturday and Sunday to be shared by both the parents. It is clarified that all contentions of both the parties regarding such modification, if any, are expressly kept open.

Writ Petition No. 10881 of 2025 :

1.

By the present Writ Petition, the challenge is to the Order dated 16th June 2025 passed by the learned Judge, Family Court No.2, Pune below Exhibit-47 in Petition D-75 of 2023. 2.

Ms. Gondhalekar, learned Counsel for the Respondent, on instructions, state that the Respondent has no objection if the Order dated 16th June 2025 is set aside by consent and said Application bearing Exhibit-47is allowed.

Accordingly, by consent of the parties, following Order is passed:

O R D E R

(i) Order dated 16th June 2025 passed by the learned Judge, Family Court No.2, Pune below Exhibit-47 in Petition No.D-75 of 2023 is quashed and set aside and said Application bearing Exhibit-47 is allowed.

(ii) By consent, Order dated 17th July 2025 passed by the learned Judge, Family Court, Pune directing "no cross" is quashed and set aside.

Accordingly, the Writ Petition No. 10881 of 2025 is disposed of in above terms, with no orders as to costs. (MADHAV J. JAMDAR, J.)
