IN THE HIGH COURT OF JUDICATURE AT BOMBAY

CIVIL APPELLATE JURISDICTION WRIT PETITION NO.10885 OF 2025 Sanjaykumar Amrutrao Patil ...

Petitioner versus Vishranti Shavarsiddha Patil and Ors.

...

Respondents Mr. Onkar A. Mane, for Petitioner.

Ms. A.A.Nadkarni, AGP for State.

CORAM: N.J.JAMADAR, J.

DATE :

8 AUGUST 2025 P.C.

1.

Heard the learned Counsel for the parties.

2.

At the outset, learned Counsel for the Petitioner seeks leave to annex a copy of the impugned order dated 4 June 2025. 3.

Leave granted.

4.

Necessary amendment be carried out forthwith. 5.

The challenge in this Petition is to an order dated 4 June 2025 passed by the Additional Divisional Commissioner, Pune in Village Panchayat Appeal No.51 of 2025, whereby the Additional Divisional Commissioner has stayed the effect and operation of the order of disqualification of the Respondent No.1 passed by the Collector - Respondent No.3 on 6 May 2025 in Dispute Application No.28 of 2024 till the next date of hearing. 6.

Learned Counsel for the Petitioner submits that though the matter was listed on 3 July 2025, the Appeal has twice been adjourned thereafter. SSP 1/2

21 wp 10885 of 2025.doc Learned Counsel for the Petitioner submitted that the appellate authority - Respondent No.2 be directed to hear and decide the appeal expeditiously. 7.

Since the Petitioner has preferred an appeal against the ad-interim order which is passed staying the execution and operation of the order of disqualification, during the pendency of the appeal, there is no propriety in entertaining this Petition. However, the appellate authority is expected to make an endeavour to hear and decide the appeal expeditiously as the order of disqualification is stayed.

8.

The Writ Petition stands disposed with a direction to the appellate authority to hear and decide the Village Panchayat Appeal No.51 of 2025 as expeditiously as possible and preferably within a period of two months from 28 August 2025, the next scheduled date before the appellate authority.
