Learned Counsel for the Petitioner relied upon the decision of this Court in the case of Dattatray Kachru Aher vs. State of Maharashtra & Ors. in Writ Petition No.1385 of 2025 dated 04th February 2025. He submitted that loan of Rs.1,80,210/- was sanctioned in favour of the Petitioner in the year 2004 by the Respondent-Loknete Dattaji Patil Sahakari Bank Limited and the proviso of Section 44A of the Maharashtra Co-operative Societies Act, 1960 will not apply. Therefore it is submitted that it was error on the part of Respondent-Bank to have initiated recovery for sum greater than the principal amount.

Issue notice to the Respondents, returnable on 15th September 2025. Private notice on Respondent-Bank is permitted. 3.

Learned AGP waives service of notice on behalf of the RespondentState. 4.
