In this writ petition, the petitioner, inter alia, has assailed the validity of the resolution dated 21st April, 2023 by which the petitioner has been blacklisted for a period of three years.

When the matter is called out, learned counsel for the petitioner submits that during the pendency of the writ petition, Nashik Municipal Corporation has passed an order dated 11th August, 2025 by which the order of blacklisting of the petitioner has been recalled.

In view of the subsequent development, learned counsel for the petitioner submits that petitioner be granted liberty to
4-WP-10894-2025.doc submit a representation with regard to its grievance for refund of EMD and the Nashik Municipal Corporation be directed to decide the said representation in a time bound manner. 4.
On the other hand, learned counsel for the respondent nos.1, 2 and 4 - Nashik Municipal Corporation submits that suitable action on the representation shall be taken. 5.
In view of the aforesaid submissions and in view of the order dated 11th August, 2025, which has been passed after filing of the writ petition, we deem it appropriate to issue the following directions: - (a) The petitioner shall submit representation to the Commissioner, Nashik Municipal Corporation seeking refund of the EMD within a period of one week from the date of receipt of copy of this order. (b) The Commissioner, Nashik Municipal Corporation shall decide the aforesaid representation within a period of four weeks by a speaking order.

It is made clear that this Court has not expressed any opinion on merits of the matter.
