IN THE HIGH COURT OF JUDICATURE AT BOMBAY
CIVIL APPELLATE JURISDICTION WRIT PETITION NO. 11100 OF 2025 Suresh Chhabildas Shah
...Petitioner
Versus
Kamleshsingh Harnamsingh Chowhan
...Respondent
Mr. Suresh Kamble, i/b O. P. Pandya, for the Petitioner. Mr. Vivek Kantawala, a/w Amey Patil, Manav Kantawala, Sharuya Singh, K. Chowhan, i/b Vivek Sharma, for the Respondent.
CORAM:
N. J. JAMADAR DATED:
13th AUGUST, 2025 PC:- 1.
Heard the learned Counsel for the parties.
2.
The challenge in this petition is to an order passed by the Appellate Bench of the Court of Small Causes in Revision Application No.189 of 2025, whereby the revision application preferred by the petitioner against a judgment and order dated 12th June, 2025 thereby rejecting an application preferred by the petitioner to reject the plaint under Order VII Rule 11 of the Code of Civil Procedure, 1973, came to be rejected. 3.
The Court is informed that, in the intervening period, the parties have led evidence and the suit is now posted for final 1/2
903-WP11100-2025.DOC arguments. The plaintiff has concluded the submissions. The submissions on behalf of the defendant are to be advanced. 4.
In this view of the matter, at this stage, this Court does not find any propriety in entertaining the petition assailing orders rejecting an application for rejection of the plaint under Order VII Rule 11 of the Code.
5.
Keeping the issues which have been raised in the application for rejection of the plaint open for consideration at the stage of final adjudication, the petition stands disposed. [N. J. JAMADAR, J.] 2/2
