After hearing learned Counsel for the Petitioners, we do not find that this is a fit case to grant interim relief as prayed for by the learned Counsel for SHAILAJA SHRIKANT HALKUDE SHRIKANT HALKUDE Date: 2025.09.03 17:52:33 +0530

920-WP-11106-2025.doc the Petitioners today, as the impugned communication/letter dated 22nd August, 2025 issued by Respondent No.5 - Upvibhagiy Jalsandharan Adhikari, itself provides that the Petitioners - Societies, which are operating in the same village where lake is located in respect of which auction is scheduled, are being given first preference, which is in consensus with the Government Resolutions relied on by the Petitioners.

Learned Counsel for the Petitioners submits that though the Petitioners - Societies will be given first preference, the subsequent clause in the impugned communication/letter which provides for bidding is illegal as the same is not contemplated by the Government Resolutions dated 9th July, 1990 and 30th December, 2020.

It is made clear that further steps taken shall be subject to the outcome of the Petition.
