This matter was heard for some time. We expressed our disinclination, keeping in view that a Special Civil Suit No.653 of 2011 (renumbered as Special Civil Suit No.114 of 2023), is pending before the learned Civil Judge, Senior Division, Thane (Link Court) at Bhiwandi (now the Court at Bhiwandi).

The learned Advocate for the Petitioner seeks liberty to withdraw this Petition with a prayer that the Suit may be expedited since it is 14 years old.

In view of the above, this Petition is disposed off as withdrawn, on instructions.

We expect the learned Civil Judge, Senior Division, at Bhiwandi to conclude and decide the Special Civil Suit No.653 of 2011 (renumbered as Special Civil Suit No.114 of 2023), as expeditiously as possible and preferably on or before 31st March, 2026. The parties to the Suit shall cooperate with the Trial Court. If adjournments are sought on unreasonable or frivolous/trivial grounds, the learned Court is at liberty to impose costs.
