Prima facie, the issue raised in this Petition stands covered by the decision of the Hon'ble Supreme Court in the case of Assistant Commissioner (CT) LTU, Kakinada & Ors. Vs. M/s. Glaxo Smith Kline Consumer Health Care Limited1, against the Petitioner.

However, the Petitioner states that even after the impugned order was made, the Respondents have discharged the bank guarantee after being satisfied of all the compliance. 3.

We keep the issue of the Petitioner not exhausting the alternate remedy open. Still, we adjourn the matter to 14 October 2025, to enable Ms. Vyas to verify whether the 2020 (19) SCC 681
