CORAM:
SUMAN SHYAM & S. M. MODAK, JJ.
DATED:
14th NOVEMBER 2025.
PC:- (PER S.M.MODAK, J) Digitally signed by LATA SUNIL PANJWANI Date:
2025.11.21 13:24:50 +0530 LATA SUNIL PANJWANI 1.
Heared learned Advocate for the Petitioner and the learned AGP.
2.
The Petitioner has filed a Revision Application No.70/2025 before Divisional Joint Registrar, Kokan Bhavan. It was filed as per the provisions of Section 154 of Maharashtra Co-operative Societies Act. In the pending revision he had prayed for an order of stay. However, it was rejected by the order dated 14th July 2025. The revision was filed thereby challenging the legality of the order dated 27th May 2025 passed by the Dy. Registrar as per the 14th November 2025
53 WP 11207.25.DOC provisions of Section 75(5) of the Act of 1960 whereby, the present Petitioner was disqualified for two years.
3.
There is an objection to the maintainability of this writ petition on behalf of learned AGP in view of the availability of alternate remedy as per the provisions of section 154 of the said Act. It is correct that a revision can be preferred before the State Government against the order passed by District Joint Registrar. 4.
The learned Advocate for the Petitioner seeks leave to withdraw this petition with liberty to file necessary revision application before the State Government as per the provisions of the Act of 1960.
5.
In view of the above, the writ petition is disposed of as withdrawn. Liberty is granted to file appropriate proceedings before the State Government.
6.
It is made clear that this Court has not expressed any opinon on the merits of the case.
