The Petitioner has already availed of a statutory remedy of preferring an Appeal and makes a statement that the Appeal is pending. Yet, this Petition has been filed for seeking issuance of a Writ of Mandamus for conducting structural audit, revoke building permissions, revoke development permissions and register a First Information Report. 2.

Since a statutory remedy has already been availed of, as per the admission of the Petitioner, we have no reason to entertain this Petition and the same is, therefore, dismissed.

Insofar as the Appeal is concerned, we would expect the Respondent No. 6 Authority to deal with the pending Appeal by following the due procedure laid down in law and by granting a reasonable opportunity of hearing to all the Stake-holders. Let the Appeal be decided expeditiously.
