SANTOSH SUBHASH KULKARNI Mr. S. C. Wakankar, a/w Aishwarya Bapat, for the petitioners. Mr. Hamid Mulla, AGP for the State/Respondent Nos.6 and 7. SANTOSH SUBHASH KULKARNI Date: 2025.08.29 11:50:35 +0530

CORAM:

N. J. JAMADAR, J.

DATED:

26th AUGUST, 2025 Oral Order:- 1.

Heard the learned Counsel for the parties.

2.

The challenge in this petition is to an order dated 15th July, 2025 passed by the Divisional Joint Registrar, Co-operative Societies, Pune, on an application for stay to the order passed by the Deputy Registrar on 3rd April, 2025 thereby directing respondent Nos.2 to 5 to admit respondent No.1 as a member of respondent No.2 Society. The Court finds that, while rejecting the application, the Divisional Joint Registrar directed that the revision application be listed for hearing on 18th August, 2025. 3.

Mr. Wakankar, the learned Counsel for the petitioner, on instructions, informed the Court that the matter was again adjourned on 18th August, 2025 and is now scheduled to be listed on 23rd September, 2025.

14-WP11315-2025.DOC 4.

Having regard to the nature of the impugned order, the Court does not find it expedient to entertain the petition. It would be appropriate that the revision application itself is decided as expeditiously as possible and after providing an opportunity of hearing to the parties. Mr. Wakankar expressed an apprehension that since respondent No.2 Society has gone for redevelopment, the benefits may be allotted to respondent No.1. A direction for expeditious hearing would take care of the apprehension on the part of the petitioner.

5.

The petition thus stands disposed with a direction to respondent No.7 to hear and decide the Revision Application No.169 of 2025 as expeditiously as possible and, preferably, within a period of two months from next scheduled date of the revision application.

6.

The parties shall appear before respondent No.7 - Divisional Joint Registrar, Co-operative Societies, Pune, on 23rd September, 2025.

7.

It is clarified that this Court has not entered into the merits of the matter and all contentions of all the parties are kept open for consideration before the Revisional Authority. [N. J. JAMADAR, J.] 2/2
