The Petitioner claims to be a Police Patil of Village Gadadarwadi, Post Khandobachiwadi, Taluka Baramati, District Pune. He was removed from his position by an order dated 29th August, 2016 passed by the Sub Divisional Magistrate, Baramati Sub Division for having more than two children, the third being born after the cut off date. He claims that he has made a request letter to the Respondent on 30th November, 2016. 2.

The learned AGP is right in pointing out that the said document is a mere letter tendered to the Respondent in which the Petitioner claims that he has been suspended. Gauri Gaekwad

In view of the above, we would expect the Respondent to deal with the said representation and respond by a communication to the Petitioner, conveying to him as to whether there is any statutory remedy available and whether the limitation has expired. Let such decision be communicated to the Petitioner within 30 days from today. If his letter can be treated as a proceeding under any provision of the Act, the same be dealt with in accordance with the procedure laid down in law, within a period of 75 days from today.
