Heard Mr. Somvanshi, learned Counsel appearing for the Petitioner and Mr. Gupta, learned Counsel appearing for the Respondent.

By the present Writ Petition filed by the Petitioner-wife against Respondent-Husband the challenge is to the legality and validity of the Order dated 8th July 2025 passed by the learned Judge, Family Court, Pune, by which the application filed by the Petitioner bearing Exhibit-14 in P. A. No.1484 of 2024 seeking access and custody of the pet dog (Tikki) for 3 days a week has been rejected on the ground that there is no such provision in law.

In view of the nature of the dispute, this Court, by Order dated 18th November 2025, appointed Mr. Hitesh Vyas, learned Counsel of this Court, as Mediator. Learned Mediator has submitted a Report dated 10th December 2025 stating that the mediation is successful. 4.
Both the learned Counsel state that the parties have arrived at an interim arrangement till the disposal of P. A. No.1484 of 2024 pending before the Family Court, Pune with the assistance of Mr. Hitesh Vyas, learned Mediator. The said interim arrangement is recorded in the form of Consent Terms. Both the learned Counsel tender the Consent Terms. The Consent Terms are singed by the Petitioner and the Respondent as also their respective Advocates. Both the learned Advocates identify the signatures of the Petitioner and the Respondent respectively. Both the Petitioner and the Respondent are present through Video Conferencing and confirm that they have arrived at interim arrangement till pendency of said P. A. No.1484 of 2024.

Accordingly, the Consent Terms are taken on record and marked "X" for identification. The Consent Terms read as under :-

1. Both the have arrived at an interim arrangement with respect to the interim custody of Pet dog (Tikki) by mutual consent on the terms and conditions contained herein.
2. The Petitioner has filed the present writ Petition seeking shared custody of the Pet dog (Tikki) for three days in a week. However, the parties have now amicably resolved the said issue and have agreed for an interim arrangement.
3. Owing to the separation between the the pet dog (Tikki) is in the custody of Respondent.
Now the Respondent agrees to give the custody of Pet dog (Tikki) to the Petitioner for two continuous weeks in a month, which shall be from the 1* day to the 14th day of every month. The Pet dog (Tikki) shall thereafter remain with the Respondent for the remaining period of that month.

5. Both parties agree that all expenses relating to the Pet dog (T1kki) including food, mnedical care, grooming and including other necessary care along with incidental costs shall be borne by the party having custody of the pet during their respective custody period.
6. Both parties agree to maintain and adhere to the established daily routine of the pet dog (Tikki) including her food, medication, exercise, training, grooming, and any other necessary arrangements to ensure her well-being, continuity of care, and to minimize stress
7. Itis agreed between the that ifeither party is required to travel or remain away for work or any other reason, the custody of the Pet dog (Tikki) shall remain with the party who is available to care for
the pet during such period.
The party who intends to travel shall inform the other party in advance.
8. To preserve continuity of care and minimize stress to the pet dog (Tikki), both parties shall share the responsibility of day care and veterinary care of the Pet Dog (Tikki), which is currently being managed by the Respondent.
Whenever necessary each party shall share all veterinary reports related to the pet with the other party.
The Respondent shall provide the Petitioner with the Designated Facility's name, address, contact details to enable seamless care.
9. Both the parties undertake to this Hon'ble Court that they shall maintain mutual dignity, respect and cordiality in all interactions pertaining to the Pet dog (Tikki) and shall ensure that the care, affection and well-being of the Pet dog (Tikki) remain the paramount consideration at all times.
10.In the event of any contingency, difficulty, or dispute arising with respect to the care, health or custody of the pet then both shall have the liberty to approach Ld. Family Court, Pune for appropriate directions or clarifications.
11.Each party shall have exclusive custody and control ofthe pet during their respective custody period, and the other party shall not
interfere, disturb or cause any obstruction in the care or management of the Pet dog (Tikki) during such period.
12.Both confirm that they have filed these consent terms without any force, coercion, undue influence or pressure.
They have filed these terms voluntarily and of their own free will and after obtaining independent legal advice.
13.This settlement constitutes one composite whole, none of the terms being severable from the other.
