1) The Petitioner has claimed relief against private individual i.e. Respondent Nos. 3 to 16 by invoking the jurisdiction of this Court under Article 226 of the Constitution of India. Admittedly Respondent Nos. 3 to 16 are not 'State' within the realm of Article 12 of the Constitution of India and therefore writ Petition against private individuals is not maintainable. 1.1) Despite the said fact, the Petitioner has invoked jurisdiction of this Court seeking reliefs, which are either amenable to the jurisdiction of a Civil Court or a Co-operative Court, as contemplated under Section 91 of the Maharashtra Co-operative Societies Act, 1960. 1/2
