DATE : 16th SEPTEMBER, 2025 P.C. :- 1.

The Petitioner's name is involved in the TET Exam Result Scam of 2019. His result has been cancelled and the TET certificate has been recalled. He claims that Respondent Nos.2 to 6, who are statutory authorities of the Education Department, should pay him arrears of back wages amounting to Rs.4,35,390/-, allegedly payable for the period from January 2020 to October 2020, along with interest at the rate of 9%. The Petitioner claims to have passed the CTET on 3rd March, 2023. Apparently, he was not qualified or eligible, when he came to be appointed. If a person is appointed dehors the prescribed qualifications, the burden would not rest upon the Government to pay salary to such a candidate from the taxpayers money, when he was not even qualified to be appointed. If he was employed by a private employer, he would be at liberty to seek recovery of any dues from such private employer, as may be permissible in law.

In view of the above, this Petition is disposed off. (ASHWIN D. BHOBE, J.) (RAVINDRA V. GHUGE, J.) Gauri Gaekwad
