1] The learned counsel for the respondent submits that he would take adjournment on the next date in the matter before the trial Court and he seeks time to argue the matter.
2] The learned counsel for the petitioner has taken me through page 160 of the writ petition i.e. clause nos. 3.4.2, 3.4.3, so also, clause 3.7 (d) and submits that he has no obligation towards the employees, which are already terminated and his highest obligation is that he has to make endeavour to retain existing manpower, which was engaged by the Corporate Debtor in relation to its business. Presently, the Corporate Debtor employs 699 employees
11862.25WP and workmen as of December 15, 2017. He further submits that he has no obligation of all employees beyond number mentioned above.
3] The learned counsel for the respondent submits that there are conditions mentioned in the sale certificate, which are accepted and the same has bearing on the present subject matter.
4] Without prejudice to the rights of the petitioner to contest the position, the petitioner may produce sale certificate with conditions, if it is available, on the next date.
5] List this matter on 14.10.2025.
