Prima facie, it appears that the order passed by the Assistant Registrar directing the society to refund the excess amount was complied with in January 2024. However, in exercise of powers under Section 79A(3)(a) of the Maharashtra Co-operative Societies Act, 1960, the Assistant Registrar has passed a subsequent order removing the managing committee. The

12-wp-11887-2025.doc Assistant Registrar shall file a personal affidavit explaining the reasons for passing such a drastic order.

Until further orders, there shall be ad-interim relief in terms of prayer clauses (f), (g), and (h).
