The Petitioner has tendered certain representations to the prospective employer, Respondent Nos.2 and 3, claiming issuance of an appointment letter as Surveyor/Clerk in the Respondent No.3, Department. The Petitioner submits that she was earlier in the waiting list. She is not aware of her serial number. Now she submits that she is in the select list. Her serial number in the select list is also not known to her. There are no pleadings in the Petition as to which select list was published in order to gather that she is enlisted in such select list.

In such circumstances, such a Petition cannot be entertained. This Writ Petition is, therefore, disposed off. 3.

We, however, note that if the Petitioner is at a particular serial number in the select list and all the candidates above her and one candidate below her, have been issued with appointment orders, the Petitioner may get a right to seek issuance of an appointment letter. If this be the position, the Petitioner is at liberty to avail of a remedy, as is permissible in law.
