1) I have heard Mr. Anturkar, the learned senior advocate appearing for the Petitioner and Mr. Godbole, the learned senior advocate appearing for the Respondent No. 2 and 3. 2) As the hearing of the Petition progressed, the Petitioner and Respondent Nos. 2 and 3 state that parties have settled all their disputes under the subject Leave and Licensee Agreement amicably. 1 of
Renuka 904-wp-11947-2025.docx 3) Parties have agreed that the Writ Petition can be disposed of without recording elaborate reasons in view of settlement occurring between the parties. While the settlement amount is agreed between the parties, there appear to be difference between them about the mode of payment. Petitioner wants to deposit the amount in this court. However, since the Petition is being disposed of, there is no point in directing deposit of the agreed amount in this Court. It is therefore appropriate that the Petitioner deposits the demand draft/pay order in the office of the Solicitor of Respondent Nos.2 and 3.
4) Accordingly, with the consent of the parties following order is passed:- (i) Petitioner undertakes to pay to Respondent Nos. 2 and 3 an amount of Rs. 8 crores (being refund of security deposit of Rs. 5 crores and compensation of Rs. 3 crores) on or before 30 April 2026, by way of single demand draft/pay order issued in the name of Respondent No. 3. The demand draft/pay order shall be deposited by the Petitioner in the office of M/s. Purnanad and Company. Subject to the Petitioner paying to Respondent Nos. 2 and 3, the amount of Rs. 8 crores by the stipulated date, Respondent Nos. 2 and 3 shall vacate and handover possession of the subject property to the Petitioner's representative on or before 31 May 2026.

Renuka 904-wp-11947-2025.docx (ii) Subject to the Petitioner paying to Respondent Nos. 2 and 3 the amount mentioned by the stipulated date, the Respondent Nos. 2 and 3 shall withdraw Suit No. 3177 of 2024 (High Court transferred Suit No. 264 of 2023) pending before City Civil Court, Mumbai on or before 15 June 2026. (iii) Petitioner shall be entitled to withdraw the amount of Rs. 5 crores deposited with the competent authority alongwith accrued interest thereon.
5) Writ Petition is accordingly disposed of.
