CORAM : RAVINDRA V. GHUGE & ABHAY J. MANTRI, JJ.

DATE : 2nd APRIL, 2026 P.C.:

1.

We have perused the affidavit filed by Mr. Vijayanand Swanand Sharma, Sub-Divisional Officer of Ulhasnagar SubDivision at Powai Chowk, Ulhasnagar, Thane dated 27/03/2026. The stand taken by the authorities in the said affidavit is that process for acquiring the Petitioner's certain portion of land, to complete the

drainage work, has been initiated under Section 126(1)(2) of the Maharashtra Regional and Town Planning Act, 1966. 2.

The learned Advocate for the Petitioner submits on instructions that on 06/04/2026, the Revenue Authorities are carrying out a joint measurement of the properties in Joveli village. The Petitioner consents for carrying out the measurement of her land at the address mentioned in the memo of the Petition, which is in the neighbourhood. The learned AGP submits that if the Petitioner is willing for such measurement, the Revenue Authorities will carry out the measurement since a process for acquisition is to be initiated. The learned Advocate for the Petitioner submits that in the process of acquisition, the Petitioner is willing to accept compensation, being a poor farmer and she would not be able to accept TDR considering her financial condition. 3.

We grant liberty to the Revenue Authorities to carry out a videography recording of the measurement activity of the Petitioner's land in order to avoid a debate upon whether the Petitioner was obstructive or the Revenue Authorities were disinclined etc. The learned AGP submits that the measurement of the Petitioner's property would be held at 14:00 hours. 4.

Parties need not wait till this order is uploaded since the

dictation of this short order is made in the open Court and the learned Advocates for the respective sides have noted this order. 5.

List this Petition on 24/04/2026.
