Heard the learned Counsel for the parties.

The challenge in these Petitions is to an order dated 10 February 2025 passed by the Deputy Collector, SRA, Mumbai, whereby in exercise of the powers under Section 33 of the Maharashtra Slum Areas (Improvement, Clearance and Redevelopment) Act, 1971, the Petitioners have been directed to be evicted from the subject premises.

Learned Counsel for the Petitioners submits that, the Petitioners have SSP 1/3
already filed appeals before the AGRC - Respondent No.1. However, their applications for interim relief have been heard and, vide notice dated 25 August 2025, the Petitioners are threatened to be forcibly evicted from the subject premises.

Mr. Patil, learned Counsel for Respondent No.1, informs the Court that AGRC - Respondent No.1 is scheduled to hold its sitting on 19 September 2025 and the Petitioners can approach ARGC - Respondent No.1 for taking up their appeals and Interim Applications for hearing on 19 September 2025. 5.
Since the Petitioners have already filed proceedings before AGRC - Respondent No.1 and as per the instructions of Mr. Patil, AGRC - Respondent No.1 is scheduled to hold its sitting on 19 September 2025, these Petitions can be disposed by requesting AGRC - Respondent No.1 to take up the appeals preferred by the Petitioners against the orders dated 10 February 2025 on 19 September 2025 and pass appropriate orders on the applications for stay to the execution, operation and implementation of the orders dated 10 February 2025.

To facilitate AGRC - Respondent No.1 to pass appropriate orders and also rule out the possibility of prejudice to the Petitioners, in the event AGRC is not able to take up the appeals preferred by the Petitioners, the execution, operation and implementation of the orders dated 10 February 2025, shall remain stayed for a period of two weeks from 19 September 2025. SSP 2/3

The Writ Petitions stand disposed.

It is clarified that this Court has not entered into the merits of the matter and all contentions of all the parties are kept open to be raised before the AGRC.
