When the Court expressed its disinclination to entertain the petition, Mr. Shah, the learned counsel for the petitioner, seeks permission to withdraw the petition with liberty to file an application for regularisation of the structures before the Municipal Corporation. 3.

Mr. Shah further submits that to facilitate the petitioner to file such an application, no coercive action be taken against the petitioner for a period of four weeks.

Leave granted.

Petition stands dismissed as withdrawn with liberty to the varsha

In the event such an application is filed within a period of one week from today, the respondent-Corporation shall not take any coercive action against the petitioner for a period of three weeks thereafter.

If such an application is filed, within the said period of one week, the respondent-Corporation is at liberty to decide the said application on its own merits and in accordance with law. 8.

If such an application is not filed within the said period of one week, this order shall not preclude the respondent-Corporation from proceeding in accordance with law.
