This is an attempt on behalf of a person occupying premises of the respondent-housing society, who has failed to pay the society's dues for nearly thirty years, to challenge the order passed under Section 154B-29 of the Maharashtra Co-operative Societies Act, 1960. The challenge, instituted in the year 2024, is primarily on the ground that the account extracts furnished by the society are not signed and that the society is not entitled to recover dues beyond a period of three years.

On perusal of the impugned orders, it is evident that the account extract furnished by the society does not levy compound

907-wp-12299-2025.doc interest. It appears that an earlier managing committee had furnished an account extract indicating compound interest, which was later on corrected by the then managing committee. 3.

A further perusal of the account extracts indicates that the dues pertain to monthly maintenance charges levied by the society. I find no illegality, disproportionality, or unreasonableness in the amount sought to be recovered by the society. The monthly maintenance charges sought to be recovered range from 200 to ₹ 760 per month ₹ for the period from 1995 to 2022, which cannot be said to be excessive or arbitrary.

In the above circumstances, no interference is called for. The writ petition stands dismissed.
