Heard learned counsel for the respective parties. 2.

The only substantive relief sought by the petitioner in this Petition is, prayer clause 'b', which reads thus :- 1/3

" b. That this Hon'ble Court may kindly be pleased to issue a writ of Mandamus or any other appropriate writ, order or direction in the like nature thereby directing the Respondent Nos. 1 to 6 to decide the Gunthewari proposals dated 03.10.2003 and 10.10.2003 in respect of the plot bearing S. No. 52/4/1/27, Baner, Taluka Haveli, District Pune as expeditiously as possible and in any case within a period of 2 weeks."

Since this is the only relief sought by the petitioner, we requested Mr. Abhijit Kulkarni, who generally appears for Pune Municipal Corporation to appear in the aforesaid Petition before us.

Since the only relief is as stated aforesaid, we dispose of the Petition, with a direction to the Planning Authority i.e respondent No.2 to decide the Gunthewari proposal dated 3rd October 2003, 10th October 2003 in respect of Plot bearing Survey No. 52/4/1/27, Baner, Taluka Haveli, District Pune as expeditiously as possible and in any event within two weeks from the date of receipt of this order.

We make it clear, that we have not gone into the merits of the proposals made by the petitioner before the Planning Authority and as such keep all contentions of all parties on merits open.

Petition is disposed of with the aforesaid directions. All the concerned parties to act on the authenticated copy of this order.
