These matters were heard for some time. A pass over was granted.

The learned Advocate for the Petitioners submits that the Petitioners desire to withdraw these Petitions and would approach the Civil Court in the pending Civil Suits initiated by the same Petitioners, wherein an application for joint measurement of the Suit properties would be made.

In view of the above, both these Petitions are disposed off as withdrawn, on instructions.

Needless to state, if the Petitioners move an application for appointment of TILR or any other appropriate officer for joint measurement of the said properties, the Trial Court shall consider and decide the said applications in the two Suits, by following the due procedure laid down in law and after granting a reasonable opportunity of hearing to all the parties. The contentions of all the stakeholders are kept open.
