A suit for partition and separate possession between private individuals is pending before the Trial Court. The rights of the Petitioner, to the extent of shares in the property, have not been crystallized. On this premise, a Writ of Mandamus cannot be issued against a statutory authority.

The learned Advocate for the Petitioner submits, on instructions, that all contentions be kept open before the Trial Court in view of the pleadings, and that the Petitioner desires to withdraw this Petition.
