At the outset, Mr. Shukla, learned Counsel for the Respondent states that the Writ Petition is not maintainable in view of the availability of an alternate remedy under Section 34 of the Maharashtra Rent Control Act, 1999.

In view of said contentions, Mr. Mayur Faria, learned Counsel for the Petitioner seeks withdrawal of the Writ Petition with liberty to file appropriate proceedings. 3.

Accordingly, the Writ Petition is allowed to be withdrawn and disposed of with liberty to file appropriate alternate proceedings.
