CORAM:
SUMAN SHYAM & MANJUSHA DESHPANDE, JJ.
DATED:
14th OCTOBER 2025.
PC:- 1.
Heard Mr. Kishor Patil, learned counsel for the Petitioner. 2.
By filing this Writ Petition, the order dated 11th September 2025 passed by Respondent No. 1, invoking the power under Section 73(1)(D) of the Maharashtra Co-operative Societies Act, 1960, issuing a certificate as per Form M-19 of Rule 57(a)(7) of the Maharashtra Co-operative Societies Rules, 1961, in his capacity as Presiding Officer of the Special Meeting held on 11th September 2025, wherein a No Confidence Motion brought against the Petitioner was passed, has been challenged. The Petitioner has assailed the impugned order on the ground of procedural irregularities; however, during the course of argument, the learned counsel for the Petitioner could not substantiate his plea on such count. Moreover, we have taken note of the fact that nine out of 14th October 2025 Rushikesh
19 WP.12815.2025.DOC twelve members have voted against the Petitioner and thereby passed the No Confidence Motion by means of which he has been removed from office.
3.
Such being the motion and having regard to the projection made in the Writ Petition, we are of the view that there is no good ground for this Court to interfere in the matter. The Writ Petition is accordingly, dismissed.
