The Petitioner is aggrieved by the order dated 12th September 2023 passed by Education Oicer, Zilla Parishad, Kolhapur whereby the proposal for grant of approval to the appointment of petitioner has been rejected.

Mr. Utkarsh Desai, learned Counsel for the Petitioner submits that had the authority given an opportunity of hearing to the Petitioner and school management, they would have been able to convince the authority and to explain the queries. In view of this, order dated 12th September 2023 passed by the Education Oicer, be treated as show cause notice to the Petitioner and management. The Petitioner as well as management (Respondent Nos.6 and 7) shall Patil-SR 1 of

934 wp-12819-2025(c).doc appear before the Education Oicer, Zilla Parishad, Kolhapur on 9th February 2026. The Education Oicer to hear the parties and decide the subject matter proposal by giving an opportunity of hearing to the Petitioner and the school management, on its own merits. 3.

Since the proposal itself was forwarded by Respondent Nos.6 and 7, i.e., the school management, we are disposing of this petition with directions, as are given above.

The Petitioner and management are at liberty to place the caselaws before the Education Oicer to support their claim. The Education Oicer shall consider the case laws and then only decide the proposal.
