Petitioner is aggrieved by the order dated 21st January 2025 passed by the Education Oicer (Secondary) Zilla Parishad, Sangli whereby proposal dated 16th January 2025 in respect of Petitioner's appointment is turned down by the Education Oicer. 2.
It appears that there are two predominant objections raised by the Education Oicer. Firstly, the Petitioner was appointed on 15th June 2016, however, proposal was iled after 9 years. Secondly, the Education Oicer has recorded that after the issuance of Government Resolution dated 23rd June 2017, appointments are to be made through Pavitra Portal. We cannot fathom the logic applied by Education Oicer on this objection for the reason that admittedly, the Patil-SR 1 of
935 wp-12820-2025(c).doc Petitioner's appointment is dated 15th June 2016, ie., much prior to the introduction of Pavitra Portal by Government Resolution dated 23rd June 2017. In view of this, we do not ind that the objection at serial no.3 in the impugned order is sustainable. Hence, that objection is overruled. Likewise, the objection no.5 does not sustain as the Government Resolution dated 10th June 2022 is obviously much after the date of Petitioner's appointment.

Considering the delay of 9 years in iling the proposal, we deem it appropriate to relegate the Petitioner and school management to the Education Oicer to explain the delay and convince the authority on delay.

In view of the above, writ petition is disposed of with directions to the Education Oicer, Sangli to give opportunity of hearing to the Petitioner and school management on the point of delay in iling the proposal. The Education Oicer shall pass appropriate orders on the said proposal, on its own merits after giving an opportunity of hearing to the parties, within a period of 12 weeks from today. 5.
Writ petition stands disposed of.
