Heard Mr. Rajeshirke, learned Counsel for the petitioner and Mr. Vanarase, learned A.G.P, for respondent - State. 2.

The petitioner has challenged the legality and validity of notice of hearing dated 4th April, 2025 ("Exhibit J", page No.59 of the petition). It transpires that respondent No.4 - The Residential Deputy Collector, Kolhapur has issued notice to some persons, including the petitioner to appear and represent before him in hearing dated 15th April, 2025. Mr. Rajeshirke, learned Counsel for the petitioner is not in a position to explain as to what proceedings occurred after the date of hearing i.e after 15th April, 2025.

We find that the petition is premature. The petitioner can appear before the said Authority and file his detailed reply to the said Authority demonstrating how he cannot be subjected to the said notice. On passing appropriate order in the said notice, the petitioner is at liberty to take recourse available in the Courts of law.

All contentions are kept open.

Needless to mention that the concerned Authority shall also take into consideration the award dated 29th April, 2000 in Land Reference No.17 of 1980, on which the petitioner relies. 7.
