It is in hundreds of matters that we have passed orders quashing the conclusions of the Authorities of the Education Department who raised objections in regard to the certain deficiencies in the proposal and yet rejected the proposal without granting an opportunity to the Management to submit a revised proposal. In all these matter, the impugned orders have been passed by Shri Sandeep Sangve, Divisional Deputy Director, Education, Mumbai, whose similar orders have been set aside by this Court over the last 2 years. He was in fact, cautioned. Yet, similar orders are passed.

In view of the above, these Petitions are disposed off with the following directions :

(a) The impugned orders shall be treated as notices to the Management.

(b) The Management shall deal with the objections raised and submit a revised proposal within a period of 45 days from

today to Respondent No. 3.

(c) Respondent No. 3 would consider the revised proposal and if any further objections are to be raised, he would issue notice to the Management and grant an opportunity to the Management to clarify on the new deficiencies. (d) After Management has tendered the revised proposal, Respondent No. 3 would deal with the said proposal strictly in accordance with law and pass a reasoned order within a period of 30 days thereafter.

(e) The order shall be communicated to the Management on its email address within 3 days of the passing of the order. (ASHWIN D. BHOBE, J.) (RAVINDRA V. GHUGE, J.)
