P. C. :- 1) By this thoroughly misconceived Petition, the Petitioners are challenging Show Cause Notice dated 1st August, 2025 issued under Section 78(A)(1)(b) of The Maharashtra Co-operative Societies Act, 1960, by the Respondent No.1.

1.1) A bare perusal of the impugned Notice clearly indicates that, the Respondent No.1 has called upon the Petitioners to submit their written say/explanation and to appear before it on 19th August, 2025 along with necessary documents, to plead its case.

2) Thus, there is a remedy provided in the said Notice itself by the 1/2

Despite the said fact and though the Petitioners were having alternate remedy as stated in the said Notice itself, the Petitioners have rushed to this Court by filing present Petition under Article 226 of the Constitution of India on 19th September, 2025. It is the reason at the inception we have stated that, present Petition is thoroughly misconceived.

3) Mr. Damle, learned Senior Advocate appearing for the Petitioners submitted that, the concerned Authority in the Notice itself has decided the issue of jurisdiction and has indirectly expressed his mind to confirm the said Notice.

3.1) We are not in agreement with the submission of the learned Senior Advocate, in that behalf. It prima facie appears to us that, the concerned Authority has reproduced the pleadings of the Applicant therein and the reply filed by the Society.
