The order impugned in the writ petition is passed in exercise of the powers under Section 75(5) of the Maharashtra Cooperative Societies Act, 1960. Both parties have agreed that the impugned order dated 19th September 2025 can be set aside, and the matter be remitted to the Registrar for a fresh decision in the light of the judgment of this Court in Kailash Maheshwari & Ors. vs. State of Maharashtra & Ors. (Writ Petition No. 10587 of 2025), decided on 25th September 2025. Accordingly, the order dated 19th September 2025 and the consequential order of appointment of the Administrator are set aside.

The Deputy Registrar shall grant both parties the liberty of hearing and shall decide the issues involved between the parties afresh, in accordance with the principles laid down in Kailash Maheshwari (Supra).
