In fact this is second round of litigation, that the petitioner is required to approach this Court seeking direction to respondent/Caste Scrutiny Committee to decide the tribe claim of the petitioner. On the earlier occasion in Writ Petition No.6234 of 2022 this Court by an order dated 21.06.2022 had directed the Caste Scrutiny Committee to decide the tribe claim of the petitioner on or before 31.12.2022. However, till today the Caste Scrutiny Committee has not decided the tribe claim of the petitioner.

In the meanwhile, again the petitioner has been served with show-cause notices dated 10.10.2025 and 15.10.2025 calling upon the petitioner to submit the tribe validity certificate failing which the service of the petitioner would be brought to an end. 3.

Considering the above, we direct the respondent/Caste Scrutiny

2 984.doc Committee to decide the tribe claim of the petitioner within a period of six months from today.

Till the tribe claim of the petitioner is decided, the employer/s of the petitioner shall not take any coercive action against the petitioner. 5.

We make it clear that petitioner shall extend full co-operation for deciding the tribe claim of the petitioner.

The protection granted by this Court will operate only till the tribe claim of the petitioner is decided and he would not claim any equities.
