By this writ petition, the petitioner is taking an exception to the common judgment and order dated 03.09.2025 passed by the respondent/Scrutiny Committee thereby invalidating tribe claim of the petitioner of belonging to "Koli Mahadev" Scheduled Tribe.

Learned counsel for the petitioner submits that the same common judgment and order, which is impugned in this

(2) petition, was challenged by the close blood relatives of the petitioner namely Avinash Ramhari Gandhale and Amar Ramhari Gandhale by filing Writ Petition N. 10842 of 2025 and this Court, by an order dated 4th September, 2025, has quashed and set aside the impugned common judgment and order.

Learned A.G.P. does not dispute the said fact nor the relationship of the petitioner with those validity holders. 5.

In that view of the matter, we are inclined to pass the following order.

ORDER

i) The Writ Petition is partly allowed.

ii) Impugned order dated on 03.09.2025, passed by Respondent No.2 Scrutiny Committee is hereby quashed and set aside.

iii) Respondent No.2 Scrutiny Committee shall immediately issue "Koli Mahadev" Scheduled Tribe Validity certificate in favour of the Petitioner, which shall be subject to following conditions:- (a) The caste validity certificate shall be subject to the outcome of the re-verification of the validity certificates of her blood relatives proposed by the Scrutiny Committee.

(3) (b) The Petitioner shall not claim any equity.

(c) The Petitioner shall co-operate with the Scrutiny Committee.

iv) Shri Ramhari Antram Gandhale, paternal cousin uncle of the petitioner and other paternal blood relatives of the Petitioner, who are served with notice of revocation of validity, shall furnish undertaking before the Scrutiny Committee, stating that they will cooperate and appear before the Scrutiny Committee as and when called upon.
