At the outset, learned AGP raises preliminary objection. She states that vide letter dated 09.06.2025 which is at Exh.'G' at page No.56 of the petition, the petitioner's license to do mining has been cancelled and hence it is open for the petitioner to challenge the same before the Appellate Authority which is the Additional Collector.

In view of the objection raised by the learned A.G.P., learned Counsel for the petitioner seeks leave to withdraw the petition with liberty to challenge the cancellation of the excavation permission earlier granted on 08.01.2025, before the Additional Collector.

Petition is accordingly disposed of as withdrawn with liberty as prayed.
