DATED : 01 December 2025 P.C.:- 1.
Heard learned counsel for the parties.
2.
Ms. Aditi S. Naikare, learned counsel for the petitioner, fairly states that after the institution of this petition, the petitioner paid the certain charges under protest, and now, the goods have already been released. Ms. Naikare fairely submits that the main relief in this petition stands worked out but she craves leave to take out appropriate proceedings with regard to the charges that the petitioner was required to pay under protest or without prejudice before the appropriate forum.
3.
Accordingly, we dispose of this petition, now that the
36-WP-13172-2025 (C).DOCX main relief in this petition stands worked out. We, however, grant the petitioner liberty to take out said proceedings as may be permissible under law before the appropriate forum with regard to the charges paid by the petitioner under protest or without prejudice for the release of the goods.. 4.
All contentions of all parties in this regard are expressly kept open.
5.
The petition is disposed of with liberty in the above terms. No costs.
6.
All concerned to act on an authenticated copy of this order.
