The present Writ Petition takes exception to order dated 08.08.2025 passed below Exhibit-82 by Civil Judge Senior Division, Gangakhed in Regular Civil Suit No.118/2017, whereby application filed by respondents/plaintiffs seeking amendment in plaint has been allowed.

Mr. Jadhavar, learned Advocate appearing for petitioner submits that amendment has been sought at fag end of proceedings, after commencement of the trial, and same could not have been allowed.

On other hand, Mr. Undre, learned Advocate appearing for respondents submits that amendment does not change nature of suit and it was necessary for final adjudication of dispute between parties. He would further bring to notice of this Court that order directing amendment is already implemented. The plaint is

(2) 59-wp-1341-2025.odt accordingly amended. Not only that, petitioner has also filed his amended written statement to said plaint.
