12 December 2025 ORDER :
1.
Matter has been placed today for directions pursuant to
the order dated 8th December 2025.
2.
By the said order, the submission of Mr. Setalvad, the learned Senior Counsel for the Petitioner in Writ Petition No. 13453 of 2025, had been recorded that inspite of order dated 13th October 2025, DRT-III had failed to dispose of Interim Application within four weeks from the date of the said order. A last chance was given to DRT-III to dispose of Interim Application by passing orders thereupon.
3.
It was recorded in the said order that inspite of the prior orders passed by this Court, DRT-III had failed to dispose of the Interim Application.
4.
Pursuant to the said order, the respective Petitioners have filed their additional Affidavits. We have noticed from the additional Affidavits that inspite of the matter being listed by the DRT-III on several occasions, the DRT-III has failed to hear and dispose of the Interim Application.
5.
Accordingly, we consider it appropriate in the circumstances to hear the present Writ Petitions itself rather than wait for the DRT-III to dispose of the Interim Application. 6.
The Writ Petitions shall be placed for hearing at the admission stage on 19th December 2025 at 1:30 p.m. 7.
The Petitioners shall serve notice of this order on the Respondents that the Writ Petitions are being taken up for hearing at the admission stage and file Affidavits of Service prior to the next date.
8.
It is made clear that in the event, the Respondents do not make an appearance on the next date, inspite of notice having been served, the Writ Petitions shall be heard in their absence. [FARHAN P. DUBASH, J.] [R.I. CHAGLA J.] Sharayu Khot.
