Heard the learned Counsel for the parties.

The challenge in this petition is to the order dated 9th October, 2025 passed by the Deputy Commissioner of Police, Mira-Bhayandar under the Maharashtra Police Act, 1951 read with Sections 238 and 239 of the Licensing and Controlling Places of Public Amusement (other than Cinemas) and Performances for Public Amusement, Including Melas and Tamashas Rules, 1960, whereby the license of the petitioner to run Orchestra has been suspended for the period of 90 days. 1/2

The learned Counsel for the petitioner submits that the petitioner is in the process of filing the statutory appeal against the impugned order.

In the event, the petitioner files the statutory appeal by 16th October, 2025, the said appeal be listed before the Divisional Commissioner on 17th October, 2025. 5.
The Divisional Commissioner is requested to hear and decide the appeal expeditiously and, if it is not possible to hear and decide the appeal, the Divisional Commissioner shall pass an order on the application of interim stay to the impugned order.

The petition stands disposed.

It is clarified that this Court has not entered into the merits of the matter and the Divisional Commissioner shall decide the appeal/application on its own merits and in accordance with law.
