Having heard the learned counsel for the parties, we are of the view that the Petitioner is a deserving candidate having secured 91% in the last year of Diploma in Civil Engineering and was otherwise, eligible for admission in Second-year lateral entry into Civil Engineering (B.E.) for the academic year 2025-26.

Accordingly, a Committee shall be constituted of the Respondent No.1 - College and which Committee shall include a Member of the State Entrance Cell (CET), Maharashtra to consider the Petitioner's case and for which, the Petitioner shall make a detailed representation including the averments made in the present Writ Petition as well as the documents relied Pallavi 1/2
2 905-WP-13517-2025 (C).doc upon including, the fact that the Petitioner had submitted OBC (NonCreamy Layer) Certificate to the Respondent No.1- College. The Committee shall take a decision within a period of four weeks from receipt of the Petitioner's representation. Also, the representation shall include the Petitioner's right to the vacant post/seat and/or to the supernumerary post, which will also be decided by the said Committee, in accordance with law. 3.
The Committee so appointed shall take into consideration the Petitioner's eligibility to the Second-year lateral entry into Civil Engineering (B.E.) for academic year 2025-26 and factor in that schedule of examinations for the said course for the academic year 2025-26 has already been fixed and which examinations are being held from 27 April 2026. A Copy of the said schedule is tendered to this Court by Mr. Gavand, learned counsel for the Respondent No.1 and taken on record and marked as 'X' for identification.

We make it clear that we have not expressed any opinion on the merits of this Petition and all rights and contentions of the parties are expressly kept open.
