The learned Advocate for the Petitioner tenders the original Affidavit-cum-Undertaking dated 14th October 2025, sworn before the Notary-Government of India (3 pages). The same is taken on record and marked as 'X-1' for identification. He submits that the Affidavit-cumUndertaking is to make a statement before the Court that within 3 months, the Petitioner would himself demolish the entire structure, which is the first floor of the property bearing Gram Panchayat House No. 528 on Gut No. 203/A at Belgaon Dhaga, Taluka & District-Nashik. He further submits that the bank, which is in the rental premises on the ground floor, would also be evicted and that portion which is illegally Gitalaxmi

He tenders a copy of the notice dated 14th October, 2025 served on the Nashik Metropolitan Regional Development Authority, which has affixed a stamp of acknowledgment of receipt. The same is taken on record and marked as 'X-2' for identification. 3.

Despite the service of notice on the sole Respondent, no appearance is caused today, either in the Court Hall or through the Video Conferencing mode.

Issue notice to the Respondent, returnable on 26th November, 2025. This matter would appear on the 'Urgent Supplementary Board'. Considering the Affidavit-cum-Undertaking, X-1, we direct the Respondent not to demolish the said residential house of the Petitioner until the returnable date.
