The learned AGP has placed on record written instructions received from the Education Officer (Secondary), Zilla Parishad, Thane, dated 16.01.2026. A photostat copy of the same is marked as 'X' for identification. It is further submitted that the Government Resolution (GR) dated 28.06.2016 has been superseded, and a fresh GR dated 01.04.2021 has been issued. The impugned order dated 09.12.2020 can be set aside and the matter can be remitted to the Office of Respondent No.3 to be decided afresh in the light of the GR dated 01.04.2021. Trupti ...1

In view of the above statement on written instructions, the impugned order loses its efficacy. The matter stands remanded to Respondent No.3, who shall consider the proposal on its own merits in the light of the GR dated 01.04.2021 and pass a reasoned order within a period of 60 days from today. Since the Petitioner has been receiving salary till date, there would be no impediment for the payment of salary.
