By the present Writ Petition filed under Article 227 of the Constitution of India, the Petitioner is challenging legality and validity of the Order dated 3rd October 2025 passed by the learned Judge, Small Causes Court, Mumbai below Exhibit-188 in R.A.E. & R. Suit No.869/2193 of 1993.

At the outset, Mr. Sapre, learned Counsel for the Petitioner seeks withdrawal of the Writ Petition with liberty to challenge the impugned Order in the Appeal, if ultimately said Suit is decreed in favour of the Respondents.
