We have heard the learned counsel for the parties yesterday (16th October 2025) when we passed an order considering the complexion of the dispute in the petition.

Learned counsel for the Municipal Corporation of Greater Mumbai (`MCGM') on instructions of Mr.Nitin Shinde, Assistant Engineer (Maintenance, R-North Ward, Mr.Amol Bodkhe, Sub Engineer and Mr.Ashutosh Gharat, Junior Engineer, who are present in the Court, makes a statement that during the course of the day, the allotment letters shall be issued to the four Petitioners who are stated MANISH SURESHRAO THATTE Date: 2025.10.17 18:11:34 +0530 to be eligible. The allotment letters will be issued by Mr.N.K.Vengurlekar, MANISH SURESHRAO THATTE Assistant Commissioner, R-North Ward, Dahisar (West), Mumbai. Manish Thatte

The Petitioners shall accordingly collect their allotment letters and possession of the tenements be handed over to the Petitioners during the course of the day. We are also informed by the learned counsel for MCGM on instructions that the tenements being offered to the Petitioners, are habitable. 4.
We accept the aforesaid statements as made on behalf of the MCGM. 5.
In this view of the matter, no further adjudication of the petition is called for.

We clarify that except whatever is stated above, we have not adjudicated the petition on merits. All contentions of the parties are expressly kept open. 7.
The petition is accordingly disposed of. No costs. 8.
