Learned counsel for the petitioners has tendered an affidavit of the petitioners. The same is taken on record and copy thereof is served on the learned counsel appearing for the respective respondents. They all seek time to go through the same.

As far as notice issued by the Government of India, Directorate General of Health Services, which is at Exhibit - H at Page - 90 of the Petition is concerned, learned Counsel appearing for the Respondent No.4, on instructions states that the said notice applies only to deemed and Central Universities and does not apply to private colleges. She therefore, states that the State Government is free to pass their own rules / regulations.

At this juncture, learned AGP on instructions states that the contesting respondent would be the Maharashtra Higher and Technical Education Department, Maharashtra State and that the said department needs to be impleaded as party respondent.

In view of the statement made by the learned AGP, learned counsel for the petitioners seeks leave to amend to implead the said Maharashtra Higher and Technical Education Department, Maharashtra State as respondent No.6.

Leave granted. Amendment to be carried out forthwith during the course of the day.

Learned counsel for the Petitioners also seeks leave to amend the prayer clause. Leave granted. The said amendment also to be carried out during the course of the day and amended pages be served on the counsel appearing for the respective respondents. 7.

Learned AGP waives notice on behalf of respondent Nos. 1, 2 and 6.
