The Petitioner has faced litigation earlier. He has now become a Pharmacist. The pay scale was not being granted to him. Hence, the Chief Officer, Municipal Council, Yeola forwarded his proposal dated 07th June, 2017 for fixation of the pay scale to Respondent No. 3 - District Collector, Nashik. Since then, it is said to be pending.

In view of the above, this Petition is disposed off with the direction to Respondent No.3 that, if the said proposal dated 07th June, Gayatri Shimpi

918-WP-13795-2025.odt 2017 has still not been decided, the same shall be decided on its own merits by following the due procedure laid down in law, within a period of 30 days from today. If the proposal is rejected, Respondent No.3 would assign reasons. If the proposal is allowed, the decision would be communicated to the Petitioner and Respondent No. 4, by speed post acknowledgment due or by e-mail. The order or decision would be dispatched within 24 hours of its passing.

If the Petitioner is aggrieved, he would be at liberty to assail the said decision. If the pay scale is settled by Respondent No.3, the Petitioner would draw benefits as are permissible in law for the period of 3 years preceding the filing of this Petition, or the date on which he is held eligible for the pay scale, whichever is less.
